ModemMoms.com Privacy Statement

ModemMoms respects privacy of Internet Users and does not collect personally identifying information without the Internet User's permission.

This policy applies to the web sites owned or operated by ModemMoms, Inc., a Florida corporation ("ModemMoms").

You may contact us regarding this Privacy Policy by e-mail at legal@ModemMoms.com

Some terms used in this Policy are:

"Advertiser" - which means a person or organization that has entered into a ModemMoms Advertiser Service Agreement with ModemMoms and operates a Web site that pays for a sale, lead or click by an Internet User referred by a Publisher.

"Publisher" - which means a person or organization that has entered into a ModemMoms Publisher Service Agreement and may be compensated for a sale, lead or click by an Internet User that the Publisher referred to an Advertiser's Web site.

"Cookies" - which are small pieces of information that are stored by an Internet User's browser on the Internet User's hard drive.

Collection of Data

ModemMoms does not collect Internet User identity or contact information from Internet Users' visits to ModemMoms Web Sites. For each visitor to a ModemMoms Web site, the visitor's computer reaches us via a particular IP, (Internet Protocol), address. ModemMoms's servers automatically collect this IP address.

An Internet User's browser sets Cookies (when enabled) that contain small amounts of data on the Internet User's computer after a visit to any web site. Cookies assist ModemMoms in tracking Internet Users' activities beginning from a Publisher's web site or subscription e-mail through an Advertiser's web site that the Internet User links to from the Publisher's site or e-mail. If the Internet User re-visits the Advertiser's site directly, ModemMoms is able to continue to track the Internet User's activities on the Advertiser's site and reward the Publisher that referred the Internet User. The Cookies themselves tell ModemMoms nothing about the Internet User personally.

Cookies are used in two stages of ModemMoms tracking: when an Advertiser's banner image is loaded on a Web page for viewing by an Internet User and when the banner is clicked by an Internet User. The function of these Cookies is to provide ModemMoms with information solely for the purpose of paying Publishers commissions when an Internet User clicks on a link, creates a lead, or makes a purchase on an Advertiser's Web site.

No information is obtained from the Internet User or Internet User's computer to generate the unique identifying number of the Internet User. ModemMoms's servers automatically generate the unique number. None of ModemMoms's Cookies are used to perform "User Profiling".

ModemMoms does receive and record partial e-mail addresses of Internet Users, only in circumstances where the Internet User has voluntarily provided its identity and contact information through the Advertiser's Web site or Publisher's Web site. This partial e-mail address does not enable ModemMoms to personally identify an Internet User.

If a Web site using ModemMoms's tracking technology were to provide any personally identifying information to ModemMoms beyond name and/or e-mail address, ModemMoms would discard that information immediately.

Disabled and Non-functioning Cookies

ModemMoms does not employ any technology or means of preventing an Internet User from disabling the acceptance of a Cookie. Most Web browsers automatically accept cookies, but an Internet User's browser may be set by the Internet User to disable this function. Some Web browsers or similar Internet navigating technology may not support (or consistently support) Cookie technology. If Cookies are disabled or the Internet User is utilizing technology that does not adequately support Cookie technology, ModemMoms shall not be able to record the Internet User's click on an Advertiser's link that was placed on a Publisher's Web site or within a subscription e-mail or the Internet User's subsequent activity at the Advertiser's Web site.

Use and Disclosure of Data

ModemMoms does not sell or rent personally identifying information. ModemMoms does not disclose personally identifying information to anyone that ModemMoms is not authorized to do so. ModemMoms uses anonymous user data to create and report the browsing, purchasing and/or lead form completion activities of anonymous users.

ModemMoms reserves the right to release information on Internet Users if compelled to do so by proper judicial or governmental authorities. Disclosure shall be limited to only to those that ModemMoms is compelled to disclose to. At present, all information processing occurs in the United States.

Security Measures

ModemMoms employs industry standard security measures to ensure the security of all data. Access to ModemMoms customer data is accessible via password protection through the Advertiser and Publisher Accounts created by each Advertiser and Publisher, and to designated ModemMoms employees who require system level access in order to perform their jobs. Access to Internet User data that identifies the Internet User's name and/or e-mail addresses is limited to designated ModemMoms employees who require such access in order to perform their jobs and to an Advertiser or Publisher that provided such information. Each Advertiser and Publisher is responsible for maintaining the confidentiality of its own password used for accessing its accounts on the ModemMoms Network.

Publisher and Advertiser Privacy

ModemMoms does not share with anyone other than an Advertiser, personally identifiable information about a Publisher, and vice versa. Such exchange is limited to a party's e-mail address and basic Account detail (including but not limited to Web site name (if applicable), date Web site or subscription e-mail first entered into operation, and visitor demographics). Such information shall be accessible to enable each party (an Advertiser and a Publisher) to assess a potential affiliation with the other party and, when an affiliation has been established, to facilitate the on-going relationship. The parties may contact each other before entering into an affiliation (e.g. for the purpose of soliciting affiliation, and other similar commercial solicitations) and after an affiliation for the purpose of sending and receiving targeted commercial e-mail solicitations regarding special promotions and affiliation opportunities. Once an affiliation is established, the parties are privy to recorded information regarding the affiliation results, including anonymous Internet User transaction data for Internet Users referred by the Publisher. If a Publisher has been given permission by the Internet User to record personally identifiable Internet User transaction data (e.g. through rewards membership programs), the anonymous Internet User transaction data may be coded by a Publisher to enable the Publisher to generate personally identifiable Internet User transaction data. Under the foregoing circumstances, the information remains anonymous to ModemMoms. By completing the registration process, Publishers and Advertisers agree to be solicited by Advertisers and Publishers (respectively) for the foregoing purposes. All other personally identifiable information of Advertisers and Publishers that is provided by them during the sign-up process is retained and used by ModemMoms in order to serve the Publisher and the Publisher's Advertisers through processes such as performance reporting and commission payments to Publishers. Advertisers and Publishers have agreed with ModemMoms not to engage in spamming, unsolicited e-mail and indiscriminate advertising. Each Advertiser and Publisher may view or modify the information that it provided during sign-up.

Advertiser and Publisher Web Sites and Publisher Subscription E-mails

Although ModemMoms requires Advertisers and Publishers to adhere to Good Business Practices as a condition of Membership in the ModemMoms Network, ModemMoms is not responsible for the information practices of Advertisers or Publishers. Advertisers and Publishers may collect information from or about Internet Users, including personal information. The collection, use, and disclosure of information by Advertisers and Publishers are subject to their respective privacy policies, which may differ from ModemMoms's Privacy Policy.

Spam

ModemMoms does not intentionally send unsolicited e-mail messages that could legitimately be construed as spam. ModemMoms's Advertisers and Publishers are held to the same standards.

If you inform ModemMoms that ModemMoms has collected or received information from a child under 18, ModemMoms will delete such information immediately from its databases. No ModemMoms Web Site is specifically directed to children under 18. ModemMoms shall not knowingly distribute to third parties any personally identifiable information erroneously collected from children under 18.

Deactivating or deleting from databases by Publishers and Advertisers

Policy Changes

ModemMoms may find it necessary or be legally obligated to update this Privacy Policy from time to time. Any changes will be posted at this site. Except as otherwise required by law, modifications to this Privacy Policy will not affect the privacy of data collected by ModemMoms prior to the effective date of the policy change.
